§ 62-3. Enforcement; violations; penalties.

  • (a)

    Issuance of parking tickets. The police department of the town, acting through certified law enforcement officers or parking enforcement specialists, as designated pursuant to F.S. § 316.640(3)(c)1 and 2, shall issue municipal parking tickets, on ticket forms authorized by the town manager, to the operator if the motor vehicle is attended, and if the motor vehicle is unattended, attach such ticket, issued to the owner, to the vehicle in a conspicuous place.

    (b)

    Contents of parking ticket. The ticket shall specifically describe the following:

    (1)

    Describe the illegally parked motor vehicle;

    (2)

    Indicate its location;

    (3)

    Specify the nature of the violation;

    (4)

    Indicate the amount of the fine;

    (5)

    Give notice to the violator that he must pay the fine within ten days; and

    (6)

    Describe the procedures to be followed in either paying such fine or electing not to pay such fine and requesting a hearing before a county judge concerning the parking violation, and the penalty for failure to comply with the directions on the ticket.

    A sequential numbering system shall be used.

    (c)

    Failure to pay fine; referral of violation to county court. If the fine is not paid within the ten-day period, the police records clerk (deputy court clerk) shall send, by registered or certified mail, to the person to whom the citation was issued, a notice that if the fine, plus a delinquency fee, is not paid to the town within ten days after the date of the notice, the violation will be referred to the county court for disposition in accordance with the procedures set forth in F.S. ch. 318, known as the Florida Uniform Disposition of Traffic Infractions Act, or any successor statute. The town hereby adopts a civil traffic hearing officer program pursuant to F.S. § 318.325, and its successor statutes, for the referral of all violations of this chapter. Violations of this chapter shall be referred to a civil traffic hearing officer as provided by the county court of the seventh judicial circuit. The appearance before the county court or hearing officer of persons who fail to comply with the provisions of this chapter will be compelled by the issuance of a summons by the clerk or any deputy clerk of the court. A warrant shall be issued by the court for the arrest of any person who fails to appear in response to such summons.

    (d)

    Schedule of fines and delinquency fees. The schedule of fines and delinquency fees to be assessed under this section shall be as set by resolution.

    (e)

    Continuing violations. Each day any violation occurs or continues shall be a separate offense.

    (f)

    Liability for payment of fine. The owner is responsible and liable for payment of any parking ticket violations.

    (g)

    Computation of time. If the last day of any time period described in this section falls on a Saturday, Sunday or legal holiday, the time period shall run until the end of the next day which is neither a Saturday, a Sunday nor a legal holiday.
